Policy on Access to information

The access to public bodies information policy aims to increase transparency and standardize methods and procedures for public access to information held by public bodies.
In addition, this policy recognizes the right of any person or entity, to access to information, prepared or held by public bodies, whether the central and regional departments of State administration, the local communities, public enterprises and establishments, and whatever their date, medium or form or through proactive disclosure of public or at the request of the person concerned.

Legal framework

Access Guide to information

In the context of the application of the right of access to information for any natural person or legal entity regardless of its date, its form and its support of this information. They have to proceed with a written request.

1. Submission of an application:
A. Access to information: Any natural or legal entity may present a written request.

  • Deposited at the Office of Relations with Citizen against compulsory delivery,
  • Or sent by registered letter with acknowledgment of receipt to the following address: Tunisair, Boulevard Mohamed Bouazizi . Charguia II 2035 Tunis – Carthage,
  • Or sent by e-mail to: accesinfo@tunisair.com ,
  • Or by fax +216. 31370296 with acknowledgment of receipt.

Pre-established model is available for public by Tunisair’s head office at the Office of Relations with Citizen and Tunisair web site .
B. If the applicant of access to information is unable to write request, in the case of handicap or incapacity of reading or writing, the responsible of access to information is required to provide the necessary assistance to the applicant of access to information.
C. In compliance with art. 10 and 12 of the Organic Law N°. 22-2016, the request shall obligatorily comprise, in the case of a nature person, the name, the first name and the address; if it is about a legal entity the corporate name and the head office . In addition, the application must contain the necessary details of requested information.
D. If the request do not comprise the minimum mentions provided for the articles 10 and12, the responsible for access to information shall notify the applicant by any means leaving a written record, within a deadline not exceeding fifteen (15) days as from date of its reception of the request.

2. Deadline

A. Tunisair must provide a response to any request within a deadline not exceeding twenty (20) days.
B. It is possible to shorten this period, if the request for access to information would have consequences on the life or the freedom of a person. In this case, Tunisair must be diligent to respond immediately without exceeding forty eight (48) hours.The deadline provided may be extended by ten (10) days with notification to the applicant of access if the application relates to several information or requires consultation with other parties.
C. When Tunisair does not have the required information, it shall, within five (5) working days from the receipt of the request .The responsible of the access to information have to inform the applicant of its incompetence or of the transfer of the request to the concerned entity .
D. Tunisair is not required to respond more than once to the same applicant, in case of requests for the same object and without valid reason.

3. Ways of Access to information:

At the time of the formulation of the request , it is imperative to specify the method of access to information selected.
among the following methods:
  • Consultation of information on the spot if this does not cause him any damage.
  • Obtaining a paper copy of the information
  • Obtaining an electronic copy of the information
  • Obtaining extracts of the information.

4. Notification

A. When the right of access to information is possible, Tunisair shall inform the applicant by written notification about:
  • The mode that it would be possible to access the requested information.
  • Paying fees if it is required.
  • The place where information can be accessed
B. When access to information is not possible, the applicant must be informed of it, giving the reasons for the refusal and the provisions of the law that have been applied and informing him of the methods of recourse against the decision of refusal.

5. Costs

A. In principle any person has right to free access to information.
B. If the supply of the requested information requires expenses incurred by Tunisair; the applicant shall be pre- informed of the need for paying an amount provided that it does not exceed the real costs incurred by Tunisair.
C. The information required will be provided, only after justification of the payment of the due amount.

6. The appeal:

A. In case of rejection of the request or violation of the provisions of the Organic Law 2016-22 ,The applicant of access to information may make an equitable relief to the Tunisair Chief Executive Officer within a deadline not exceeding twenty (20) days following the decision notification. The Chief Executive Officer of Tunisair is required to answer him within the shorts possible time provided that not to exceed a maximum deadline of ten (10) days as from the date of deposit of the application in revision.
B.The request of equitable relief is presented in accordance with the form available at the Office of Relations with the Citizen or on the website of Tunisair.
C . In the event of refusal of the request by Tunisair Chief Executive Officer or in event of failure to response on his part at the expiry of the deadline of ten (10) days as from the date of reception of the request of revision,the applicant may lodge an appeal in front of the Authority of Access to Information and this within a deadline not exceeding twenty (20) days as from the reception of the decision of refusal of Tunisair Chief Executive Officer or of the date of tacit refusal. The Authority that rules on the appeal in the shorted deadline provided they do not exceed forty five (45) days as from the reception of the request ,its decision is constraining for Tunisair.
D. The applicant and Tunisair may lodge an appeal against the decision of the authority in Charge of Access to Information, at the Administrative Tribunal within thirty (30) days as from the date of notification of this decision.
